1. Fan Club Terms
Welcome! The following are the terms of use (” Fan Club Terms”) that govern your use of the websites and applications where this appears (collectively, the ” Site”) for all premium access to The Who (“Artist”) digital content. Our Privacy Policy and Website Terms of Use and any other policies, rules or guidelines that may be applicable to particular offers or features on the Site are also incorporated into these Fan Club Terms. By visiting or using the Site, you expressly agree to these Fan Club Terms, as updated from time to time.
We may make changes to these Fan Club Terms at any time. Any changes we make will be effective immediately when we post a revised version of these Fan Club Terms on the Site. The “Last Updated” date above will tell you when these Fan Club Terms were last revised. By continuing to use this Site after that date, you agree to the changes.
While some of the events listed on the Site may appeal to children, the Site is not targeted at children under the age of 13, and they are not permitted to use the Site. We strongly encourage all parents and guardians to monitor the Internet use by their children. If you use the Site, you affirm you are at least 13 years old. Once set up your subscription entitles you and your household to access Site digital content. A valid email address and registration to create a login is required for access to the Fan Club Terms of registration can be found here. If your subscription price increases, we will give you at least 10 days’ notice and the new price will only become effective from the next payment date.

3.Our Contract with You
3.1 How We Will Accept Your Order
Our acceptance of your subscription will take place when we email you to accept it, at which point a contract will come into existence between you and us.
4. Subscription Offers
Some offers may not be available to previous subscribers. If the offer includes a free gift, your free gift will be dispatched within 14 days of your subscription starting. Free gifts apply to Site subscriptions worldwide. Promotional offers and incentives are subject to availability and may be changed at any time.
5. Membership Duration
Unless otherwise stated, memberships are for one year and renew automatically on an annual basis. We will grant only one membership per person. If we determine that a single person has joined (or attempted to join) more than once, or if we receive multiple membership applications from a single and/or cluster of e-mail addresses verified to single person, we may cancel all applicable memberships and invalidate any tickets purchase via the membership(s).
Cancellation
You may cancel your subscription to the Site at any time by emailing thewhocommunity@gmail.com. Cancellation will become effective at the end of your current billing period. You will not receive a refund or credit for your current billing period. You may continue to access the subscription-only features of the Site for the remainder of your current billing period.
6. Payment Types
The subscription fee for Wholigan membership is $50.00 (fifty US dollars), Super Wholigan $70.00 (seventy US dollars) and Ultimate Wholigan $80.00 (eighty US dollars and such payments shall be recurring on an annual basis by Credit Card. Promotional offers may have payment type or payment frequency restrictions. A recurring payment will be collected on an annual basis from the day of initial subscription. You will be prompted of renewal at the end of the first subscription year.
No Refunds.
PAYMENTS ARE NONREFUNDABLE, AND NO REFUNDS OR CREDITS WILL BE GIVEN FOR PARTIAL OR INCOMPLETE USE. We reserve the right, in our sole discretion, to provide refunds, discounts or credits to subscribers on one or more instances without obligation to do so in the future.
7. Prizes and Competitions
From time to time, you will be notified of promotional giveaways or prizes you may be offered from this subscription. Upon notification, you will be provided a link to the promotion and eligibility rules and terms and conditions.
8. Pre-Sale Tickets for Who tours
8.1 You will receive your unique pre-sale code via email at a specified date together with a link to the ticket provider’s website where you can redeem the pre-sale code to purchase tickets once the pre-sale window opens. We cannot accept responsibility if the email we send to the email address you have provided does not reach you for any reason beyond our reasonable control including where the email is flagged as spam.
8.2 The Who Fan Club pre-sale, powered by TicketMaster, will go live at a specified date. The pre-sale code will give you access to an exclusive pre-sale window, where you’ll get the chance to buy a maximum of 4 tickets before general release to the public. The pre-sale code can only be used once and must be redeemed by the specified date. The pre-sale code is personal to you and cannot be used by anyone else.
8.3 Only a limited number of tickets are available. There is no guarantee that you’ll be able to buy tickets to the show using your pre-sale code. All tickets are subject to availability. Bravado accepts no liability with any issues around ticket purchasing from our third-party partners. The pre-sale code can only be subject to the terms and conditions applicable at the time of purchase of the tickets. You must be 18 years or older to purchase pre-sale tickets from the ticket provider. We are not the ticket provider so cannot be responsible for any issues with the purchase of or your use of the tickets.
8.4 Pre-sale codes have no cash value, and are non-transferable, case-sensitive, and good for one-time use only. By registering to receive a pre-sale code you are deemed to have accepted these terms and conditions. Any personal data you provide when registering to receive a pre-sale code will be used in accordance with the Privacy Policy which you can read here https://privacy.umusic.com/uk).
8.5 General Pre-Sale Terms
We may make available certain tickets or ticket packages, including presale tickets, as a benefit to fan club members. You will be redirected to our ticket partners’ websites where tickets can be purchased and are typically subject to a per ticket service fee and a non-refundable per order processing fee. In many cases, delivery prices will also be owed. You will be limited to 4 tickets for each event (also known as a “Ticket Limit”). This Ticket Limit is and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices. We reserve the right to cancel any or all orders and tickets without notice to you if you exceed the posted limits. This includes orders associated with the same name, e-mail address, billing address, credit card number or other information.
Orders are processed only after a billing address, and other billing information, has been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. In these cases, we will attempt to contact you, using the information provided at the time of purchase. If we are unable to reach you after our initial attempt, we may cancel your order and may sell your tickets to another customer without further notice.
If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.
Different combinations of delivery methods may be offered, depending on factors that include the venue or country where the event is to be held, the country in which you live, how much time is left before the event starts, whether it is a holiday season and the nature of the demand for the event. Please carefully review the list of delivery methods offered during the purchase process. For security purposes, we can only ship tickets to the billing address on file with the credit card company that is used for your purchase.
Opening acts or guests may sometimes tour with headlining performers. We are not always made aware of opening acts or the length of their performances. Opening acts, as well as festival performers, are subject to change or cancellation at any time without notice. No refund will be owed if an opening act or festival performer is changed or cancelled.
Before purchasing tickets, carefully review your event and seat selection. We will not issue exchanges or refunds after a ticket has been purchased or for lost, stolen, damaged or destroyed tickets.
Occasionally, concerts are cancelled or postponed. Should this occur, we will attempt to contact you to inform you of refund or exchange procedures for that concert. For exact instructions on any cancelled or postponed concert, please check the concert information online or contact us. If the event was moved or rescheduled, we may be able to substitute tickets with comparable or better seat locations in our discretion. Please contact us for more information if you cannot attend the rescheduled event.
You agree that you will not attempt to evade, avoid, or circumvent any refund prohibitions in any manner with regard to tickets you purchased. Without limiting the generality of the foregoing, you will not contact us to seek a refund or exchange from us when we are prohibited from providing one, and you will not dispute or otherwise seek a “chargeback” from the company whose credit card you used to purchase tickets from the Site. Should you do so, your tickets may be cancelled, and we may, in its sole discretion, refuse to honour pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using the Site.
If we are able to issue you a refund for a ticket due to a cancelled or postponed event, we will issue a refund of the ticket’s face value paid (or, for a discounted ticket, then instead the discounted ticket price paid) and all service fees. In no event will delivery charges or any other amounts be refunded. If a refund is issued, it will be issued using the same method of payment that was used to purchase the tickets. We will not be liable for travel or any other expenses that you or anyone else incurs in connection with a cancelled or postponed event.
If the amount you pay for a ticket is incorrect regardless of whether because of an error in a price posted on this Site or otherwise communicated to you, or you are able to order a ticket before its scheduled on-sale or presale date or you are able to order a ticket that was not supposed to have been released for sale, then we will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction.
Event providers reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with event provider rules. Breach of terms or rules will terminate your license to attend the event without refund. A ticket is a revocable license and admission may be refused upon refunding the ticket’s face amount. A ticket is not redeemable for cash.
You agree that the event for which you purchase tickets is a public event, that your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the event. You grant permission to the event provider(s) to utilize your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.
You and your belongings may be searched on entry to the event. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, laser pointers, strobe lights, irritants (e.g., artificial noisemakers), bundles and containers.
Unlawful resale (or attempted resale), counterfeit or copy of tickets is grounds for seizure and cancellation without compensation. Certain maximum resale premiums and restrictions may apply in some states and we cannot be responsible for providing legal advice regarding resale or pricing of tickets. You are responsible for complying with all applicable ticket resale laws. In addition, we reserve the right to restrict or deny ticket purchasing privileges to anyone that we determine to be, or has been, in violation of our policies. Tickets may not be used for advertising, promotions, contests or sweepstakes, unless formal written authorization is given by us.
9. Limited License
Bravado grants you a non-exclusive, non-transferable, limited right to access, use and display this website and the materials thereon; provided, however, that you comply with these Fan Club Terms. You agree not to disrupt, interrupt or attempt to interrupt the operation of the Site in any way. You agree not to change or delete any proprietary notice from materials downloaded from the website. You agree to comply with all trademark, copyright and other laws worldwide in your use of this website and to prevent any unauthorized copying of the materials and information contained on this website. Except as expressly provided herein, Bravado and/or the Artist does not grant any express or implied right to you under any patents, trademarks, copyrights or trade secret information.
10. Disclaimer and Indemnity/Limitation of Damages
You agree to indemnify, defend and hold harmless Bravado, the Artist, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the website against any and all losses, expenses, damages and costs, including reasonable attorneys’ fees, incurred in relation to, arising from the use of this website (including a breach of these Fan Club Terms), the content, materials, submissions and functions of this website, even if it Bravado and/or the Artist are expressly advised of the possibility of such damages. Bravado and/or the Artist cannot and does not guarantee or warrant that any of the materials available for downloading through this website will be free of infection of viruses, worms, “Trojan horses” or other code that has an intent other than what the description of the content says. You are responsible for implementing sufficient safe guards and procedures to satisfy your requirements for the security and safety of your systems. By accessing this Site you assume total responsible and risk for the use of the materials on this website.
10.1 Incorrect Information
The materials and information contained on this website may contain inaccuracies and/or typographical errors. The Artist and/or Bravado does not warrant the accuracy or completeness of the materials or other information displayed or distributed through the website. You acknowledge that any reliance on this information shall be your sole risk. Bravado and/or the Artist reserves the right at its sole discretion to make corrections or omissions to any portion of this website without notice.
This website, the information and materials provides on this website are provided “AS IS” and Bravado and/or the Artist does not make any express or implied warranties, representations or endorsements whatsoever including, without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness of any particular purpose with regard to the website, any merchandise, information or service provided through the website. As a result Bravado and/or the Artist shall not be liable for any cost or damage arising either directly or indirectly from any such transaction.
11. Links to Third Party Sites
Some of the links on this website will take you to third party sites. Where possible the Bravado has taken care to provide you notice that you are leaving the website. If you decide to visit any third party site you do so at your own risk and take responsibility of taking protective measures to guard against malicious content on the third-party site. The Artist and/or Bravado does not control these linked sites and is not responsible for their contents and as makes no warranty or representation regarding the information contained on third-party sites. You acknowledge and agree that the content (other than content that may be submitted by Members), materials, text, images, videos, graphics, trademarks, logos, button icons, music, software and other elements available on the Site are the property of Bravado, the Artist or our licensors and are protected by copyright, trademark and/or other proprietary rights and laws. You agree not to sell, license, rent, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, modify or create derivative works from any content or materials on the Site. All other trademarks are the property of their respective owners. All rights reserved. Except as expressly set forth in these terms, no license is granted to you and no rights are conveyed by virtue of accessing or using the Site.
13. Our Rights To End The Contract
We may end the contract for the subscription services at any time by writing to you If you do not make any payment to us when it is due and you still do not make payment within 10 days of us reminding you that payment is due.
14. Limitation of Liability
In no event will we or the Artist or our event providers, suppliers, advertisers and sponsors, be responsible or liable to you or anyone else for, and you hereby knowingly and expressly waive all rights to seek, direct, indirect, incidental, special or consequential damages of any type other than out of pocket expenses, and any rights to have damages multiplied or otherwise increased, arising out of or in connection with the site, the content, or any product or service purchased through the site, even if we have been advised of the possibility of such damages, and regardless of whether the claim is based upon any contract, tort, or other legal or equitable theory.
15. Indemnification
You agree to indemnify Bravado/ the Artist and its group company’s liabilities and the reasonable costs (including reasonable legal fees), sustained or incurred as a result of content posted to the Site by you being in violation of these Fan Club Terms.
16. Governing Law
The operation of our Site, and contracts for the purchase of goods through our site are governed by English law. Any dispute arising from, or related to, such contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
